Assistant Disclosure & Recording Notice

The short version: when Holina answers a business's phone, the caller is told at the start of the call that they are speaking with an automated virtual assistant and that the call may be recorded for quality. They can ask for a person at any time. The assistant answers only from information the business itself provided, and it says "I don't know" rather than guessing.
Callers are told, every time
Every greeting on every Holina line includes a disclosure, spoken before any substantive exchange. A typical greeting sounds like:
"Thanks for calling — this is our virtual assistant, and this call may be recorded for quality. How can I help you today?"
"Gracias por llamar. Soy el asistente virtual — esta llamada puede ser grabada para control de calidad. ¿En qué puedo ayudarle?"
The assistant is automated software, not a person. It will never claim to be a human, and it will confirm that it is an automated assistant if a caller asks. Businesses using Holina may not ask for this disclosure to be removed — that restriction is in the Terms of Service and the Acceptable Use Policy.
Recording and consent
A written transcript of a call is treated, under most state wiretap laws, the same way as a recording. So rather than trying to detect where each caller is and behaving differently, Holina discloses on every call, in every state. A caller who continues after hearing the disclosure has consented.
- Transcripts — a text record of the conversation is always kept, and retained for 13 months.
- Caller audio — processed to convert speech to text and not stored by default.
- Full audio recording — off unless a business explicitly turns it on in writing. Where enabled, recordings are retained for 90 days, and the business is responsible for any further notice its jurisdiction requires.
- These states require all parties to consent before a call is captured, which is why the disclosure is unconditional: California, Connecticut, Delaware, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Oregon, Pennsylvania, Vermont, and Washington. Where a caller and a business are in different states, the stricter rule is applied.
- If a caller objects to being recorded, the assistant offers a callback from a person, and the transcript for that call is deleted on request.
What the assistant can and can't do
- It answers only from information the business itself supplied and approved — its hours, menu, services, policies. It is built to decline rather than guess: if it doesn't know something, it says so and offers to take a message.
- Responses are generated by automated software. Despite testing and safeguards, they can occasionally be imperfect. Do not rely on them as professional advice. The assistant does not give medical, legal, financial, or tax advice, and nothing it says creates a binding commitment on the business's behalf beyond an order or appointment it confirms.
- It is not an emergency service. It cannot summon police, fire, or medical help. In an emergency, hang up and dial 911.
- It does not take card numbers by voice. Nobody from Holina, and no Holina assistant, will ever ask a caller to read out a payment card number.
Reaching a person
A caller can ask for a human at any point — "let me speak to someone", "is anyone there", or simply saying they'd rather not talk to an assistant. The assistant will take their details and alert the business, and where the business has configured a transfer number, connect them. Callers are never trapped in a loop to prevent them reaching a person.
