EpochCore LLC ("Provider") respects intellectual property rights and expects its customers to do the same. Holina hosts business content — menus, documents, descriptions, and images — that customers upload or that we read from a customer's own website at their direction. If you believe such content infringes your copyright, this page explains how to tell us and what we will do.

Note: Provider's agent designation is being filed with the U.S. Copyright Office directory. Notices sent to the address above are received and acted on regardless of the filing status.

Sending a takedown notice

To be effective under 17 U.S.C. § 512(c)(3), your written notice must include all of the following:

  1. A physical or electronic signature of the copyright owner, or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed — or, if multiple works, a representative list.
  3. Identification of the material claimed to be infringing, with enough detail for us to find it: the business name, the phone number, the page URL, or the file name.
  4. Your contact information: name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorized to act on their behalf.

Please be accurate. Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees. If you are unsure whether a use is infringing — for example, if it may be fair use — consider seeking legal advice first.

What we do when we receive a notice

  1. We acknowledge receipt, usually within 2 business days.
  2. If the notice is complete, we remove or disable access to the identified material expeditiously.
  3. We notify the customer who supplied it, give them a copy of the notice, and explain the counter-notice process.
  4. Removing a menu or document may change how that business's assistant answers callers. We tell the customer that so they can respond, but we do not delay removal for it.

Counter-notice

If you are a customer whose content was removed and you believe the removal was a mistake or a misidentification, you may send a counter-notice to the agent above containing:

  1. Your physical or electronic signature.
  2. Identification of the material removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, mailing address, and telephone number.
  5. A statement that you consent to the jurisdiction of the U.S. District Court for the district in which your address is located (or, if outside the United States, the Western District of North Carolina), and that you will accept service of process from the person who sent the original notice.

We will forward your counter-notice to the original complainant. If they do not notify us within 10 business days that they have filed an action seeking a court order to restrain the activity, we may restore the material in 10 to 14 business days.

Repeat infringers

Provider maintains and enforces a policy of terminating, in appropriate circumstances, the accounts of customers who are repeat infringers. Repeated valid notices against the same account will result in suspension and may result in termination for cause under the Terms of Service and the Acceptable Use Policy.

Trademark and other rights

For trademark, publicity, or other non-copyright claims — including a business name, logo, or voice being used without authorization — email john@holina.io with the same level of detail. We handle these on substantially the same timeline.
